It is essential that you carefully read and that you understand these Booking Conditions which contain important information. They constitute the contract between Sentiers de France and you for the services provided by Sentiers de France and set out the basis of your legal relationship with Sentiers de France. By booking with us and paying the deposit, you acknowledge that you have read and understood and that you agree to be bound by these Booking Conditions.
1- Making your booking
To make a booking, you must complete our booking form. This must be signed by the party leader on the booking ("the leader"). The leader is responsible for making all payments due to us. The completed signed booking form must then be sent to us together with the payments referred clause 2 below. Once we have received your booking form and all appropriate payments, we will, subject to availability, confirm your tour by sending a booking confirmation and a sales contract to the leader in accordance with the french trade rules
In order to confirm your chosen tour, a deposit of 30% of the total cost (or full payment if you send the booking form to us within one month of departure) must be paid at the time of booking. If the booking is not accepted the deposit paid and submitted with the booking form will be refunded.
The balance of the tour price must be received by us not less than 30 days prior to departure. If we do not receive all payments due (including any surcharge where applicable) in full and on time, we will send you a written reminder. If you do not pay all payments due in full within 7 days of receiving this reminder, we reserve the right to treat your booking as cancelled by you. In this case the cancellation charges set out in clause 5 below will be payable.
3- Last minute booking
When it’s possible we accept booking made within the week of departure. The full payment is made only by credit card and you have to pay and extra fee of 40 euros for an express delivery of the tour dossier at the first hotel you will stay.
4- Cancellation by Sentiers de France
Sentiers de France reserves the right to cancel the departure and will advise you of such cancellations in written. We will offer you alternative arrangements and if the price of your alternative booking is of lower value than the original booking we will refund the difference to you. If you do not accept alternative arrangements we will refund all payments you have made to Sentiers de France, less any unrecoverable costs incurred by Sentiers de France, but we will not be liable under any circumstances whatsoever for any claims made by you for any additional costs incurred by you.
If you have paid your booking in full, Sentiers de France will pay you a compensation of an amount equal to the cancellation charges due in a reverse case.(cancellation by you – see clause 5 below)
Sentiers de France will not be liable for any delay in, change to or cancellation of trips due to Force Majeure. Force Majeure means a circumstance beyond the reasonable control of Sentiers de france and includes but is not limited to war or threat of war, riot, civil strike, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes. If Sentiers de France does cancel a trip as a result of Force Majeure, or government travel advice, Sentiers de France will offer you alternative arrangements and if the price of your alternative booking is of lower value than the original booking, we will refund the difference to you. If you do not accept alternative arrangements, we will refund all payments you have made to Sentiers de france less any unrecoverable costs. Sentiers de France will not be liable for any additional costs incurred by you.
5- Cancellation by Customer
Should you or any member of your party need to cancel your chosen tour once it has been confirmed, the leader must immediately advise us in writing by recorded delivery post or fax. The date when written confirmation of cancellation is received by Sentiers de France will determine the charges applicable. the following charges will be payable per person canceling , These are shown as a percentage of the total cost payable by the person(s) canceling excluding insurance premiums and any amendment charges,
- 30 days or more prior to departure - 100 euros per person cancelling (300 euros for a team of 4 or more) for walking or biking tours - 10% of total cost for self drive tour
- Between 30 and 21 days - 25%
- Between 20 and 8 days - 50%
- Between 7 and 2 days - 75%
- 2 days or less - 100%
In addition to the above charges, it may be necessary to add under-occupancy or single room supplements to other members of a party where member(s) of that party cancel.
Depending on your reason for cancellation, these charges may be recoverable under your insurance policy.
No refunds will be made if you leave a trip for any reason after the trip has begun.
6- Changes by Customer
Should you wish to make any changes to your confirmed tour, you must notify us in writing as soon as possible. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee of 80 euros per person (250 euros for a team of 4 or more) will be payable together with any costs or charges incurred by us and/or incurred or imposed by any of our suppliers. Additionally, if the alteration is within 4 weeks of the original departure date, the cancellation charges in clause 5 may be applied.
If you have any complaint about your trip, you must make it known at the earliest opportunity to Sentiers de France's local representative or suppliers, who will normally be able to take appropriate action. If you are not satisfied with their response and feel your enjoyment of the holiday is likely to be significantly affected, you should notify us in writing and we will do our best to resolve the problem. If at the end of the trip you feel your complaint has not been properly dealt with, you must notify us in writing within 30 days of the end of your trip.
8- Travel insurance
Travel insurance is strongly recommended for all Sentiers de France's hikers. Your travel insurance must cover accidents, medical expenses, including any related to pre-existing medical conditions, emergency repatriation, and personal liability. Sentiers de france also recommends it covers cancellation, curtailment and loss of luggage and personal effects. You are required to carry proof of insurance with you and produce it if reasonably requested by Sentiers de France's employees or suppliers.
9- Health, fitness and trip grades
Carefully read the information on trips and take special note of trip grades. The majority of trips are not demanding for people who are healthy and reasonably fit. Trips graded 3 and 4 require a good level of fitness. Please ensure you select a suitable holiday, and if necessary contact Sentiers de France for further advice.
Except where stated otherwise, Sentiers de France acts as agent for service providers when making arrangements for your trip.
Where Sentiers de France provides services it will do so with due care and skill. Sentiers de France is not responsible for the acts and omissions of others, including tour guides and accommodation providers or for any loss, damage or expense (including loss of money paid in advance) which you may incur as a consequence of the acts and omissions of others.
You warrant that you have not relied on any representation made by Sentiers de France which has not been stated expressly in this website or brochure.
Sentiers de France will not accept responsibility or liability for any passenger who contravenes any law or regulation of France. Any independent arrangements that you make that are not part of the Sentiers de france trip are entirely at your own risk.
Sentiers de France does not accept liability for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with this contract or in respect of a failure or omission on the part of Sentiers de France to comply with its obligations under this contract.
To the extent permitted by law, any condition or warranty which would otherwise be implied into these booking conditions is hereby excluded. Where legislation implies any condition or warranty, and that legislation prohibits us from excluding or modifying the application of, or our liability under, any such condition or warranty, that condition or warranty will be deemed included but our liability will be limited for a breach of that condition or warranty to one or more of the following: (a) if the breach relates to goods, (i) the replacement of the goods or the supply of equivalent goods, (ii) the repair of such goods, (iii) the payment of the cost of replacing the goods or of acquiring equivalent goods or (iv) the payment of the cost of having the goods repaired; and (b) if the breach relates to services, (i) the supplying of the services again or (ii) the payment of the cost of having the services supplied again.
11- Exception to Disclaimer
This disclaimer set out in these booking conditions does not attempt or purport to exclude, restrict or modify liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.
Any dispute concerning the exclusive application of these terms of sale shall be the exclusive jurisdiction of the courts of the department of Val de Marne (France), in which the head office of Sentiers de France is located Sentiers de France has taken out professional civil liability insurance with Azur Assurances . Any claim concerning a service must be sent, as quickly as possible, by mail to Sentiers de France, which shall have sole competence to issue a decision concerning disputes. If the dispute persists, it may be submitted to the quality department of the National Federation of Tourism Agencies which shall attempt to reach an amicable agreement. This contract and all matters arising from it are subject to the laws of France, and Tours courts (Indre et Loire department) only will have jurisdiction over any dispute arising under this contract.
